These terms apply when you use trysmackerz.com or buy from Smackerz LLC (“Smackerz,” “we,” “us”), a Washington limited liability company. By using the site or placing an order, you agree to these terms, along with our Privacy Policy, Refund Policy, and Shipping Policy.

1. Who can buy

You must be at least 18, or the age of majority where you live, to place an order. We currently ship only to addresses in the United States.

2. Our product

Smackerz are sour gummies sold as a dietary supplement. Read the label before eating, especially if you have allergies or dietary restrictions. They contain sugar. Gummies can be a choking hazard for young children, so keep them away from children under 4 and supervise older children.

Information on our site, including how we suggest using Smackerz before or during exercise, is general information and not medical or nutrition advice. If you have a medical condition, are pregnant or nursing, or are on a restricted diet, check with your doctor first. Endurance exercise carries its own risks, and you're responsible for your own training and fueling decisions.

Product photos are as accurate as we can make them, but packaging and color may vary slightly.

3. Orders and availability

Placing an order is an offer to buy. We accept it when we confirm your order by email. Our drops are limited, so we may limit quantities per customer, and we may decline or cancel an order, for example if an item sells out, a price is wrong, or an order looks fraudulent. If we cancel after you've paid, we'll refund you in full.

4. Prices, taxes, and shipping costs

Prices are in U.S. dollars. Sales tax is added at checkout where required. Shipping costs are shown at checkout before you pay; see our Shipping Policy. Discounts and bundle pricing apply as described at the time of purchase and can't be combined unless we say so. We may change prices at any time, but not for an order we've already confirmed.

5. Payment

Payments are processed through our Shopify checkout. You confirm that you're authorized to use the payment method you provide.

6. Shipping and risk of loss

Ownership and risk of loss pass to you when we hand your order to the carrier. If your package is lost or arrives damaged, contact us and we'll help as described in our Shipping Policy and Refund Policy.

7. Refunds

Refunds and our 30-day taste guarantee are covered in our Refund Policy.

8. Emails

If you sign up for our emails, we'll send you news about flavors, drops, and deals. You can unsubscribe at any time using the link in any email. We'll still send emails about your orders.

9. Flavor votes

Flavor votes are for fun and feedback. Results aren't binding, and we decide which flavors we make and when. One vote per person. Votes aren't a contest or sweepstakes, no purchase is necessary, and there's no prize.

10. Our content

The Smackerz name, logo, mascot, product names, photos, and site content belong to Smackerz or our licensors. You may view and share our site for personal, non-commercial purposes. Don't copy, resell, or use our brand without written permission.

11. Things you send us

If you send us ideas, feedback, reviews, photos, or other content, you give us permission to use it, including in our marketing, without paying you. You confirm you have the right to share it. We'll ask before using your name or face in an ad.

12. Reviews

Anyone who buys Smackerz can leave a review. We publish reviews whether they're positive or negative, and we don't edit what you write. By posting a review, you confirm it reflects your own honest experience with a product you bought.

We remove reviews only when they:

• say Smackerz treats, cures, or prevents a disease or medical condition;
• contain profanity, hate, harassment, or threats;
• share someone's personal information;
• are spam, off-topic, or about a different product; or
• were written by a Smackerz owner, employee, or someone paid by us without clearly saying so.

We apply these rules the same way no matter the star rating. If we ever offer something in exchange for a review, the offer won't depend on what you say, and the review will be labeled.

13. Acceptable use

Don't use our site to break the law, interfere with or try to break into the site or checkout, harass anyone, or send spam. Don't use bots, scrapers, or other automated tools to copy our content or data in bulk, or to buy up limited-drop inventory. Purchases are for personal use, not resale, unless we agree in writing.

Shopping assistants. AI assistants and other tools acting for a real customer, such as an assistant that finds or orders Smackerz at your request, are welcome. They must identify themselves as automated, must not get around security measures or purchase limits, and the customer remains responsible for the order.

14. Other services

Our checkout and payments are provided by Shopify and payment companies, and our site links to social networks. Those services have their own terms, and we're not responsible for them.

15. Disclaimers

Except as stated in our Refund Policy and to the extent the law allows, our site and products are provided “as is,” without other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. Some states don't allow these exclusions, so they may not apply to you.

16. Limitation of liability

To the extent the law allows, Smackerz is not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these terms limits liability that can't be limited by law.

17. Indemnity

If you misuse our site or break these terms and a third party makes a claim against us because of it, you agree to cover our reasonable costs of that claim.

18. Governing law

These terms are governed by the laws of the State of Washington. Any dispute will be decided in the state or federal courts in Spokane County, Washington, though either of us may bring a qualifying claim in small claims court.

19. Changes and other terms

We may update these terms by posting a new version here with a new date. The version in effect when you place an order applies to that order. If part of these terms is unenforceable, the rest still applies. These terms and the policies linked above are the full agreement between you and us about using our site and buying from us.
