Smackerz LLC (“Smackerz,” “we,” “us”) makes sour energy gummies and sells them at trysmackerz.com. This policy explains what personal information we collect, how we use it, who we share it with, and the choices you have. It covers our website, our checkout, our emails, and any time you contact us.

1. What we collect

Information you give us

• Email address when you join our email list, unlock the flavor vote, or email us.
• Your flavor vote when you take part in a vote.
• Order details when you buy: name, shipping and billing address, email, phone number, and what you ordered.
• Anything you include when you email or message us.

Payment information

You enter payment details on our checkout, which is run by Shopify. Shopify and its payment partners process your payment. We never see or store your full card number.

Information collected automatically

Our website host and our checkout record basic technical information such as your IP address, browser and device type, and the pages you request. This is used to deliver the site, keep it secure, and prevent fraud. Our checkout also records what is in your cart.

We don't ask for health information, and we don't use the information above to infer anything about your health. Please don't send us health information.

2. How we use it

• To process, ship, and support your orders, including order confirmations and shipping updates.
• To send emails about new flavors, drops, and deals, but only if you sign up. Every marketing email has an unsubscribe link.
• To count flavor votes.
• To answer your questions and handle refunds.
• To protect our site and customers from fraud and abuse.
• To comply with the law and enforce our Terms of Service.

We don't sell your personal information, and we don't share it for targeted advertising.

3. Who we share it with

We share personal information only with companies that help us run Smackerz, and only for that purpose:

• Shopify runs our checkout, payments, and order management. Shopify also processes some information under its own privacy policy.
• Payment providers process the payment method you choose, such as a card, Shop Pay, Apple Pay, or Google Pay.
• Klaviyo stores our email list, sends our emails, records flavor votes, and collects and displays product reviews. If you write a review, your first name, last initial, rating, review text, and any photos you add are shown publicly on our site.
• Netlify hosts our website.
• Google provides our business email and the fonts on our website. Loading the fonts sends your IP address to Google.
• Shipping carriers receive your name and address to deliver your order.

We may also share information with our professional advisors, when the law requires it, to protect our rights or someone's safety, or with a buyer if Smackerz is ever sold or merged.

4. Cookies and similar technology

trysmackerz.com does not use advertising pixels. Here is what it does use:

• Early-access cookie. During early-access periods, a cookie remembers that you entered the access code, so you don't have to enter it again.
• Klaviyo script. Our site loads a script from Klaviyo to show product reviews and run our email signup. It sets a cookie that lets Klaviyo recognize your browser. If you've already given us your email, Klaviyo may connect your visits to our site with your email profile so our emails are relevant. If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of that.
• Browser storage. Your browser remembers your flavor vote so the page can show it back to you. It stays on your device.
• Checkout cookies. Our Shopify checkout uses cookies it needs to process orders and prevent fraud. See Shopify's cookie policy.

If we add analytics or advertising tools, we'll update this policy first and ask for your consent where the law requires it. We treat a Global Privacy Control signal from your browser as a request to opt out of any sale or sharing of your information.

5. Your choices and rights

• Marketing email: click unsubscribe in any of our emails, or email us.
• Access, correction, deletion, and a copy of your data: email admin@trysmackerz.com with the subject “Privacy request.” Depending on where you live, these may be legal rights, but we honor them for every customer.

We'll confirm your request from the email address we have on file and respond within 45 days. You can use an authorized agent if they show us proof that you authorized them. If we deny a request, you can appeal by replying with “Appeal” and we'll review it again. We won't treat you differently for using these rights.

We may need to keep some information after a deletion request, for example order records required for taxes and accounting, and a record that you unsubscribed so we don't email you again.

6. Children

Our site is not directed to children under 13, and we don't knowingly collect their personal information. If you believe a child has given us information, email admin@trysmackerz.com and we'll delete it.

7. How long we keep it

We keep order records as long as we need them to fulfill orders and meet tax, accounting, and legal requirements. We keep your email address on our list until you unsubscribe. We delete or anonymize other information when we no longer need it.

8. Security

We use reasonable safeguards, including encrypted connections, access controls, and two-factor login on our business accounts. No system is perfectly secure, so we can't guarantee absolute security.

9. Where your information is processed

We're based in the United States and ship only within the United States. Your information is processed in the U.S. by us and our service providers.

10. Changes to this policy

We'll post any changes on this page and update the date at the top. If a change is significant, we'll tell you by email or on our site where the law requires it.
